The Lords Commissioners of His Majesty's Treasury
have had before Them Mr. Calder's letter of the
15th October, 1931 (82826/31) regarding the decision of
the Full Court of Hong Kong in the case of Rex v. Chung Tam
Kwong and others, to the effect that an accused person
cannot be convicted of piracy in circumstances where no
robbery has occurred.
Their Lordships direct me to
request you to convey to the Secretary of State the
following reply.
My Lords would be willing to ask Their Solicitor
for an opinion on the case generally and in particular on
the question of applying for special leave to appeal to the
Privy Council, and to transmit a copy of his opinion to the
Secretary of State for his information; and in view of the
nature of the issues raised in the matter the Treasury
Solicitor would no doubt wish to have the benefit of a
discussion
